2009 /2010 TERMS & CONDITIONS

The chalet is let as a single unit for 10 people, on an entirely self catering basis. Normal cleaning services are provided within the prices shown but as the change over between rentals periods is short the amount of cleaning that can be undertaken by our local agents is limited. Clients are therefore expected to leave the chalet clean and tidy. The chalet is a non-smoking property. Included in the rental is:-
+ 'Linen Service' - beds are made up for arrival and the bed linen and hand, bath & tea towels are removed on departure. Beds are changed weekly!

The prices are otherwise fully inclusive. Logs for the wood burner and normal electricity consumption are included in the price. If additional cleaning is deemed necessary, then the additional cleaning costs charged to us by our local agent will be deducted from the security deposit. Additional charges will also be charged for electricity consumption above 300KWhr per week. The tariff used is a dual tariff with the low cost between the hours of 20h00 and 04h00 the following day – using the washing machine and tumble dryer during this period after 20h00 (8pm) is therefore sensible.


Specific Terms & Conditions;

1. Rental Period
; The minimum rental period is one week and the maximum four weeks. Occupancy normally commences at 15h00 and finishes at 10h00 on each Saturday.

2. Security Deposit; A security deposit of £400.00 or €600 is payable two calendar months prior to occupancy. We retain your cheque on file and only use it if necessary.
This deposit is to cover damage to the chalet or its contents which has not been repaired or replaced by the Client. This sum however, does not limit the Client’s liability. The security deposit is also intended to fund additional cleaning if the Chalet needs cleaning beyond normal and power usage above normal levels. If items are not reported and we have to replace them we may need to add an administrative change for doing so as a number of incidental items are not available locally.
Please note we do accept small breakages can occur and do have replacement crockery in the chalet of the same design. Please do not replace breakages with alternative styles unless the item concerned is an individual one or can be replaced with an identical item. We will not charge for normal breakages of small items providing we are notified so that we can provide the replacement for the next client!

3. Prices; Prices are set in Pounds Sterling well before both the summer and winter seasons. Given that most if not all the expenses for running the chalet are in Euros there is obviously a significant exchange rate risk. Movement of the exchange rate between the Pound Sterling and the Euro might on some occasion’s mean we have to implement a supplement to the published prices. We will endeavour to minimise the occasion's when this is necessary and we will provide a minimum of 8 weeks' notice prior to the commencement of the booked holiday so that clients can make alternatives arrangements if their wish to. Once the final invoice is issued, this will become the fixed and final amount payable.
Web Published prices are occasionally adjusted to reflect the prevailing exchange rate.

4. Payments; Payments made in the UK are to be paid in Sterling drawn on a UK Bank. Payments for non-UK residents are made by bank transfer to our UK Bank in pounds sterling. Payments made for late bookings made less than 15 working days before occupancy shall be in Sterling or Euro cash or if by cheque, will need to be cleared before occupancy can commence.

5. Booking Deposit; A booking deposit of one third of the rental charges is payable on booking in order to secure the booking. However, if the booking is made before 01OCT for winter bookings and 01APR for summer bookings an advanced deposit of one sixth is payable. The balance of the deposit is then required by 01OCT for the winter season and 01APR for the summer season.


6. Cancellations; Cancellations up to three months prior to rental are charged at 33.3% of the rental cost. Cancellations made two months or more before the rental are charged at 50%. Cancellations within one month of rental are charged at the full rental cost and any refund is dependent upon the Owner being able to rent the Chalet to another Client at the same rate. A larger refund will then be payable; it will be based upon the difficulty of gaining another rental and price achieved for the replacement rental. The Owner recommends that the Clients take out holiday cancellation insurance.

7. Final Payment
; Payment amounts are in Pounds Sterling. Where payments are made in Euro they are calculated at the prevailing exchange rate at the time of the invoice date which will be 1) on booking, 2) 30 days prior to 01OCT or 01APR for the balance of booking deposit if appropriate and 3) 30 days prior to the final rental invoice which is due for payment two months prior to the rental.
Final payment for the booking must be made in full at least two calendar months prior to the rental. Failure to do so will deem the rental cancelled and the cancellation charges applied.

8. Currency; Payments can be made in Sterling or Euros; payment is not deemed to have been made until the cheque is cleared by the receiving bank.

9. Exchange Rate; The Sterling Euro exchange rate is the rate published on www.ft.com

10. Client’s Obligations;
i) Use the accommodation carefully and at all times try to keep and leave it in a clean and tidy state and to pay the cost of cleaning, renewal, repairs or redecoration necessitated by any damage incurred during the period of the occupancy (reasonable wear and tear and damage by fire excepted); not to permit any annoyance to adjoining properties; not to do or permit to be done on the premises anything which causes to be vitiated the insurance of the premises or to increase the rate of the premium for such insurance; to comply with all estate regulations (if any) effecting the accommodation, which are displayed on the premises and not to allow more than the stated number of persons agreed at the time of booking to occupy the property.
ii) To permit the Owner’s or their accredited agents ‘Chalet des Fleurs’ access to the Chalet to undertake inspections or repairs at a reasonable time of the day.
iii) Not to waste electricity or water in the Chalet.
iv) Not to allow smoking to take place within the Chalet and to ensure all smoking materials if used outside the chalet are disposed of in the receptacle provided.
v) Not bring animals or other pets to the Chalet.
vi) To leave the property as he/she would wish to find it; to leave furniture and other effects at the end of the stay in the rooms or places in which they were a the beginning of the occupancy.
vii) Clients need to appreciate that the chalet has three floors and is located on steep ground. Access therefore both internally and outside the chalet, particularly in inclement weather, can be dangerous. Clients should exercise due care therefore at all times
viii) Clients are required to provide the following information when booking in order to ensure the smooth running of the administrative arrangements;
a. indicate the estimated time of arrival after 15h00
b. a mobile phone number for contact purposes and
c. the number of guests in the party and the number of children.
Normal cleaning cost is included in the rental charges. However, this assumes the chalet is left in good order and if additional cleaning is necessary the additional costs will be deducted from the deposit as determined locally by our agents.

11. Owner’s Liability
; The Owner shall not be liable to the Client for:
i) Any defect or stoppage in the supply of public services to the Chalet, nor in respect of any equipment, machinery or appliances in the Chalet or garden.
ii) Any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owner, or
iii) Any loss, damage or inconvenience caused to or suffered by the Client if the Chalet shall be destroyed or substantially damaged before the start of the rental and in any such event the Owner shall, within seven days of notification to the Client, refund to the Client all sums previously paid in respect of the rental period.
iv) Any amount under any circumstances that exceeds the amount paid to the Owner by the Client for the rental period.
v) In 2010 a Computer WiFi facility is planned to be installed. Given the problematic nature of such installations and the reliance on the ISP to provide a satisfactory service we cannot guarantee the level of uptime or quality of service available. We will do our best to ensure a reliable quality service however.

12. Key Arrangements; Keys to the Chalet will be provided on arrival at the chalet in a ‘Key Safe’ located in the ‘Ski Locker’. On departure the chalet keys should be deposited ‘Green Post Box’ also in the car port! It is the renters responsibility to ensure that both these units are securely locked after the keys have been removed.

13. Linen & Towels; Linen, towels and tea towels for the number of guests will be provided up to a maximum of ten. Linen will be changed weekly.

14. Small Children
; A Cot and High Chair are provided.

15. Information & Descriptions; As the Owner’s of this Chalet we continue to be happy to provide information on the accommodation and the local services and facilities however, no statements made by us should be construed as warranties or representations. We confirm we have no commercial relationships with other parties in Les Gets, or elsewhere, which derive us any financial benefit as a result of any recommendation other than the small admin charge made when we arrange for ‘Ski Transfers’!

16. Breach of Agreement; If the Client is in breach of any of his/her obligations above, then the Owner or the Owner’s Agent may re-enter the Chalet and immediately thereupon the Client’s right to occupy the accommodation shall cease but without prejudice to the Owner’s rights or remedies.

17. Occupation at Client’s Risk; Use of the Chalet is at the Client’s risk and no liability shall fall upon the Owners for injury or damage to or loss of the belongings or property. The Owners do recommend that clients use the alarm system and personal safe provided and also ensure all valuable items are not left unattended in the chalet. The owner cannot however accept any loss incurred by the clients even if the precautions recommended by the owners are utilised. The owner recommends that clients take out suitable holiday insurance which includes protection for the loss, damage or accident to their property or person.

18. Legal Domain
; The rental contract shall be governed in all respects by English Law including the formation and interpretation and shall be deemed to have been made in England. Any proceedings arising out of, or in connection with, the contracts for rental based upon these terms and conditions may be brought in any court or competent jurisdiction in England. The contract terms are those published on chalet web site, www.chaletpasdechevre.com , and will be deemed to have been agreed by the client, or their agent, when a deposit or other agreed payments have been accepted by us. A copy of the contract terms that apply to a given rental will be available for distributed to clients at their request.
